When clients call
If one of these describes your situation, the conversation is worth having early. Construction disputes are cheaper to resolve before positions harden and the record is set.
A general contractor is being blamed for defects that originated in someone else's scope of work.
An owner has discovered serious problems in a building that was signed off years ago.
A developer is facing delay claims and needs to know what the contract actually requires.
A subcontractor has finished the work and cannot get paid.
A design professional is facing a claim arising out of their work on a project.
A lien has been recorded and the parties disagree about whether it is valid.
What the work involves
Construction cases turn on documents: the contract, the plans and specifications, change orders, daily reports, correspondence and the payment record. Much of the early work is assembling that record and determining what it actually shows about responsibility and damages.
From there the question is route. Some matters are resolved through negotiation once liability becomes clear. Others go to mediation, arbitration under the contract's dispute clause, or to trial. The choice is made around the client's business position, not out of habit.
