When clients call

Disputes inside a planned community are personal as well as legal. The people involved usually remain neighbors, which makes a measured, practical approach especially important.

A homeowner and the association disagree about what the covenants allow.

An architectural or improvement request has been denied, or an approval is disputed.

An association is pursuing unpaid assessments, fines or a lien.

A homeowner believes the board has acted outside its authority.

Neighbors within a community are in dispute over the use of common areas or property.

An association and a contractor are in dispute over construction or repairs to common elements.

What the work involves

These matters turn on the association’s governing documents — the declaration, covenants, bylaws and rules — along with the board’s records and the Colorado law that governs common-interest communities.

Many of these disputes can be resolved through negotiation or mediation before positions harden. When they cannot, they are litigated.
